By using the caperity.com website (“Service”) and all services provided by Caperity by Adrian Neumeyer (“Caperity”), you agree to be bound by the following terms and conditions (“Terms of Service”).
Caperity by Adrian Neumeyer reserves the right to update and modify the Terms of Service at any time without prior notice. Any new features that enhance or expand the current Service, including the release of new tools and resources, will be subject to these Terms of Service. Continued use of the Service after such changes constitutes your acceptance of the updated terms. Violation of any of the terms below may result in the termination of your account. While Caperity prohibits certain conduct and content on the Service, you understand and agree that Caperity is not responsible for content posted by users and that you may be exposed to such materials. You use the Service at your own risk.
Warranties
We strive to ensure the Content is accurate and error-free; however, Caperity by Adrian Neumeyer (“Caperity”) does not guarantee or warrant the accuracy, adequacy, or completeness of the Content available on the Caperity website.
All Content is provided “as is,” without any express or implied warranties, except those required by law that cannot be excluded. The Content may be updated or modified at any time without prior notice. Caperity does not warrant that the Caperity website or any third-party websites will be free from viruses, defects, or interruptions in access.
Limitation of Liability
Nothing in these Terms shall exclude or limit liability to the extent such limitation is not permitted by applicable law, including liability for intent, gross negligence, or injury to life, body, or health.
Subject to the foregoing, Caperity by Adrian Neumeyer (“Caperity”), including its employees, contractors, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or relating to the use of, or inability to use, the Service, regardless of the legal theory under which such liability is asserted.
To the maximum extent permitted by law, Caperity’s total aggregate liability arising out of or relating to the Service shall not exceed the total amount paid by you to Caperity for the Service in the twelve (12) months preceding the event giving rise to the claim.
Account Terms
- You must be 18 years or older to use this Service.
- You must be a human. Accounts created by “bots” or other automated methods are not permitted.
- You must provide a valid email address and any other required information to complete the signup process.
- Your login credentials may only be used by one person — sharing a single login among multiple individuals is not permitted. You may only be logged in on one browser at a time.
- You are responsible for safeguarding your account and password. Caperity by Adrian Neumeyer (“Caperity”) is not liable for any loss or damage resulting from your failure to uphold this security responsibility.
- You are accountable for all Content posted and activities that occur under your account.
- Users with a free account are not permitted to block advertisements.
- A single individual or legal entity may not operate more than one free account.
- You must not use the Service for any illegal or unauthorized purposes. In using the Service, you agree to comply with all applicable laws in your jurisdiction (including, but not limited to, copyright regulations).
Copyright and Content Ownership
- Caperity by Adrian Neumeyer (“Caperity”) does not claim ownership of the intellectual property rights to the materials you upload to the Service. Your profile and uploaded content remain your property. However, by making your pages publicly accessible, you grant others the ability to view and share your content.
- While Caperity does not actively pre-screen content, it reserves the right (but is not obligated) to refuse or remove any content available through the Service at its sole discretion.
- The design, layout, and overall appearance of the Service are copyrighted © Caperity by Adrian Neumeyer. All rights reserved. You may not duplicate, copy, or reuse any part of the HTML or CSS code or visual design elements without prior written consent from Caperity.
Payments and Merchant of Record
- Payments for the Service are processed by Paddle, who acts as the Merchant of Record. Paddle’s Checkout Buyer Terms apply to all purchases made through the Service.
- Subscription fees are billed monthly (or annually, where applicable) in advance.
Refunds
Consumer Purchases
If you are a consumer (a natural person purchasing outside of a trade, business, or profession), you may have a legal right to withdraw from your purchase within 14 days, in accordance with Paddle’s Checkout Buyer Terms and applicable law.
Where permitted by law, this right of withdrawal may not apply once the Service has been accessed, activated, or used.
If a valid withdrawal is exercised, the purchase will be cancelled and a refund will be issued by Paddle to the original payment method.
Business Purchases
If you purchase the Service on behalf of a company or for business purposes, payments are non-refundable, except where required by applicable law.
Subscriptions
Subscription fees are charged in advance. Canceling a subscription prevents future charges but does not entitle you to a refund for any unused portion of the current billing period, unless required under Paddle’s Checkout Buyer Terms or applicable law.
Refund Handling
All refund requests are handled by Paddle. If a refund is approved, Paddle will return the payment to the original payment method used for the transaction.
Paddle may refuse refunds in cases of fraud, abuse, or misuse of the Service, in accordance with their policies.
Cancellation and Termination
- You are solely responsible for properly canceling your account. You may cancel your account at any time by sending an email to support@caperity.com or by clicking the cancel link in the settings panel of the tool. Caperity by Adrian Neumeyer (“Caperity”) will confirm the cancellation via email, and your service will be terminated within 24 hours of the confirmation.
- Canceling your account will result in the deletion of your account and all associated content from the Service. This information cannot be recovered once the cancellation is processed.
- If you cancel the Service before the end of your current paid billing period, the cancellation will take effect at the end of that billing period. No further charges will be made after cancellation.
- Caperity, at its sole discretion, reserves the right to suspend or terminate your account and refuse current or future use of the Service or any other Caperity services for any reason at any time. Termination of the Service will deactivate or delete your account and result in the forfeiture of all content associated with it. Caperity retains the right to refuse service to anyone at any time for any reason.
Changes to the Service and Prices
- Caperity by Adrian Neumeyer (“Caperity”) reserves the right to modify or discontinue the Service (or any part of it) at any time, temporarily or permanently, with or without prior notice.
- Prices for all Services, including but not limited to monthly subscription fees, are subject to change with 30 days’ notice. Such notice may be given by posting the updated pricing on the Caperity website (caperity.com) or within the Service itself.
- Caperity will not be liable to you or any third party for any modifications, price adjustments, suspension, or discontinuation of the Service.
Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Federal Republic of Germany, excluding its conflict of law rules.
For business customers, the exclusive place of jurisdiction for disputes arising out of or in connection with these Terms shall be Neu-Ulm, Germany.
General Conditions
- The Service is provided on an “as is” and “as available” basis.
- Technical support is available via our support site and email. Caperity by Adrian Neumeyer (“Caperity”) does not guarantee response times for support inquiries, and responses will be provided as and when possible.
- You acknowledge that Caperity utilizes third-party vendors and hosting partners to supply the hardware, software, networking, storage, and related technology necessary to operate the Service.
- You must not modify, tamper with, or hack the Service, nor alter another website to falsely suggest an association with the Service or Caperity.
- You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, the use of the Service, or access to the Service without prior written consent from Caperity & Adrian Neumeyer.
- While we are not obligated to, we may remove content or accounts that, in our sole discretion, contain unlawful, offensive, threatening, defamatory, obscene, or objectionable material, or that violate intellectual property rights or these Terms of Service.
- Any verbal, physical, written, or other forms of abuse (including threats of retribution) directed at Caperity customers, employees, members, or officers will result in immediate account termination.
- You understand that the technical processing and transmission of the Service, including your content, may involve (a) transmissions over various networks and (b) modifications to conform to technical requirements of connecting networks or devices.
- You are prohibited from uploading “spam” or unsolicited messages.
- You must not transmit any worms, viruses, or destructive code through the Service.
- Caperity does not guarantee that:
(i) the Service will meet your specific needs;
(ii) the Service will be uninterrupted, timely, secure, or error-free;
(iii) results obtained from the Service will be accurate or reliable;
(iv) the quality of products, services, or information purchased through the Service will meet your expectations; or
(v) any errors in the Service will be corrected.
- You expressly understand and agree that Caperity & Adrian Neumeyer shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages — including but not limited to loss of profits, goodwill, use, data, or other intangible losses (even if Caperity has been advised of the possibility of such damages) — resulting from:
(i) your use or inability to use the Service;
(ii) the cost of substitute goods or services;
(iii) unauthorized access to or alteration of your transmissions or data;
(iv) statements or conduct of third parties using the Service; or
(v) any other matter related to the Service.
Caperity’s failure to enforce any right or provision of these Terms of Service does not constitute a waiver of that right or provision. These Terms of Service represent the entire agreement between you and Caperity regarding the use of the Service, superseding any prior agreements (including earlier versions of the Terms of Service).
